Terms of Use

These Terms of Use govern your access to and use of the Alcarza platform, including our mobile applications, website, and related services (collectively, the "Platform"). Please read them carefully.

1. Acceptance and Eligibility

By creating an account or using the Platform, you confirm that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are using the Platform on behalf of a business, you represent that you have authority to bind that business to these Terms.

Alcarza is operated by Alcarza Technologies Ltd, a company incorporated under the laws of the Federal Republic of Nigeria. The Platform is available to users worldwide, though certain features may be restricted by jurisdiction.

2. Accounts

You must register an account to book or list properties. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately at support@alcarza.com if you suspect unauthorised access.

We may suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a risk to other users or the Platform.

3. User Obligations

As a guest (user), you agree to:

  • Provide accurate personal information during registration and booking.
  • Use booked properties only for the purposes stated at the time of booking.
  • Respect the property, its contents, and any house rules set by the host.
  • Not exceed the maximum occupancy stated in the listing.
  • Report any damage or issues to the host promptly.
  • Not use the Platform for any unlawful purpose.

You are responsible for any damage caused to a property during your stay beyond normal wear and tear.

4. Vendor (Host) Obligations

As a vendor/host, you agree to:

  • Provide accurate, complete, and up-to-date information about your property, including photos, amenities, pricing, and availability.
  • Ensure the property is safe, clean, and matches the listing description at the time of each guest's arrival.
  • Honour confirmed bookings. Cancelling a confirmed booking without a valid reason may result in penalties, including suspension of your listing.
  • Comply with all applicable local laws, including short-term rental regulations, tax obligations, and health and safety requirements.
  • Respond to guest enquiries and booking requests in a timely manner.
  • Not discriminate against guests on the basis of race, ethnicity, religion, gender, disability, or any other protected characteristic.

Alcarza reserves the right to remove listings that do not meet our quality or accuracy standards.

5. Booking and Payment Terms

When you submit a booking request, you authorise Alcarza to charge the total amount due, calculated as the nightly price multiplied by the number of nights, plus any applicable service fees and taxes. Payment is processed securely by Paystack. Alcarza does not store your card details.

A booking is confirmed only when you receive a confirmation notification from the Platform. Until then, no contract exists between you and the host.

All prices displayed on the Platform are in Nigerian Naira (₦) unless otherwise stated. For international guests, your card issuer may apply currency conversion fees.

6. Cancellations and Refunds

Each listing may have its own cancellation policy set by the host (Flexible, Moderate, or Strict). The applicable policy is displayed on the listing page before you confirm a booking. Refunds, where applicable, are processed to your original payment method within 5 to 10 business days.

If a host cancels a confirmed booking, you will receive a full refund. Repeated host cancellations may result in penalties or removal from the Platform.

7. Vendor Payouts

Hosts receive payouts for completed bookings after the guest's check-in date, subject to Alcarza's payout schedule. To receive payouts, you must provide valid Nigerian bank account details and complete any required identity verification.

Alcarza may withhold payouts pending investigation of disputes, chargebacks, or suspected fraud. Payout amounts reflect the booking total less any applicable platform commission, as disclosed in your host dashboard.

8. Content, Reviews, and Moderation

Users and hosts may submit reviews, photos, and other content ("User Content"). By submitting User Content, you grant Alcarza a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that content in connection with the Platform.

Reviews must be honest and based on genuine experience. You must not post false, misleading, defamatory, or abusive content. Alcarza reserves the right to remove any User Content that violates these Terms or our community standards, without prior notice.

Property listings must accurately represent the property. Misleading photos, false amenity claims, or hidden fees are prohibited and may result in immediate listing removal.

9. Property Listing Accuracy and Verification

Alcarza may, at its discretion, verify property listings through document checks, photo reviews, or third-party services. Verification does not constitute an endorsement or guarantee of the property's condition or the host's identity.

Hosts are solely responsible for the accuracy of their listings. Alcarza is not liable for any discrepancy between a listing description and the actual property.

10. Prohibited Conduct

You must not:

  • Use the Platform for any illegal purpose or in violation of any applicable law.
  • Circumvent the Platform to arrange bookings or payments directly with hosts or guests.
  • Scrape, crawl, or otherwise extract data from the Platform without our written consent.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Introduce malware, viruses, or other harmful code to the Platform.
  • Harass, threaten, or intimidate other users or hosts.
  • Post spam, unsolicited commercial messages, or fraudulent listings.

11. Limitation of Liability

Alcarza is a marketplace platform. We do not own, manage, or control any properties listed on the Platform. We are not a party to the agreement between guests and hosts, and we are not responsible for the condition, safety, or legality of any property.

To the maximum extent permitted by applicable law, Alcarza's total liability to you for any claim arising out of or relating to these Terms or the Platform shall not exceed the total fees paid by you to Alcarza in the 12 months preceding the claim.

Alcarza is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, even if advised of the possibility of such damages.

12. Dispute Resolution

We encourage you to contact us first at support@alcarza.com to resolve any dispute informally. If a dispute cannot be resolved informally within 30 days, it shall be submitted to binding arbitration in Lagos, Nigeria, in accordance with the Arbitration and Conciliation Act (Cap A18, Laws of the Federation of Nigeria 2004), as amended.

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Subject to the arbitration clause above, you submit to the exclusive jurisdiction of the courts of Lagos State, Nigeria.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we'll update the "Last updated" date at the top of this page and, for material changes, notify you via the app or email. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the updated Terms.

If you do not agree to the updated Terms, you must stop using the Platform and may delete your account.
